Discovery is not just about uncovering the truth, but also about how much of the truth the parties can afford to uncover. Uncovering the truth may encounter difficulties to the extent that the requested document may have been edited or existing only on a crashed hard drive or stored on a device that is no longer operable, such as an early “zip drive” or unreadable old “floppy disc”. These scenarios suggest that data may or may not be accessible for recovery.

The Focus of this Module

During discovery, whether the producing party’s data is accessible or inaccessible, is an important element for determination. The producing party will have to provide its accessible data while it may not have to provide its inaccessible data. This module focuses guidelines to Parties on Accessible and Inaccessible ESI.
